Injured Employee Family's Rights

Under Workers Compensation laws the injured party is entitled to compensation and benefits due to the work related injury. Families do not have rights to compensation under workers compensation laws except in the case of the death of the employee.  In a case where the worker has died from a workplace injury you may want to contact a workers compensation lawyer or even a wrongful death attorney.

To understand all the laws regarding injuries, disability, and death from a work related accident it is always best to talk with a workers compensation lawyer or personal injury attorney locally. All states have different laws regarding compensation and other benefits the family of an injured worker may be able to receive.

Death benefits are normally provided to the spouse until such time they remarry. The children can receive death benefits until they reach the age of 18 in most states. In most cases, the benefits will also provide a burial allowance and a percentage of the weekly wage the employee would have received. There is a maximum cap that is available to families. There are other laws regarding children and spouses of an employee that died due to an injury or accident while at work. To ensure you know your rights under the law, you should contact an experienced employment attorney that understands workers compensation or personal injury laws of your state.
